1. DEFINITIONS
1.1 Pack or Card
Prepaid offer that includes a defined number of classes, valid for a specific period indicated at the time of purchase. May be complemented with additional options (e.g. extension of validity or change of location).
1.2 Subscription
Automatically renewable contract every 4 weeks, with or without commitment of permanence, which includes a certain number of classes. Payment is made by credit card or direct debit through the platform Bsport.
1.3 Price
Economic conditions related to the purchase of a product (pack, subscription, trial class…), visible on the platform at the time of the order. Promotions may be offered under specific conditions.
1.4 Customer
Individual or legal entity making a purchase through the platform Bsportplatform, for their own use or for a third party (for example, a parent for their child).
1.5 Affiliate
Independent structure operating locally the Swim Stars brand in Spain. Each affiliate is identified in its pool’s file on the site www.swimstars.es with the mention “Swim Stars Spain independent affiliate“. He is the only responsible for the execution of the service.
1.6 Swim Stars Spain
Licensee of the Swim Stars brand in the Spanish territory, responsible for the web platform www.swimstars.es and for the commercial and technical coordination of the service, but not for the direct provision of classes.
1.7 Coach
Qualified lifeguard or instructor, recruited and managed by the local affiliate to teach the classes.
1.8 Bsport
Company Bsport S.A.S.technical provider of the reservation platform, the Swim Stars application and the online payment system. All purchases and reservations are made through this platform on behalf of the affiliates.
2. PRESENTATION OF THE SWIM STARS SPAIN NETWORK
Swim Stars España is a national platform which brings together a network of independent affiliates operating under their own responsibility in the pools listed on www.swimstars.es.
His role is to coordinate branding, digital processes and the administrative side of sales.
The present GTC regulate the purchases made through the Bsport platform.
The provision of the service (class) is provided exclusively by the local affiliate indicated on the pool card at the time of booking.
3. PLACING AN ORDER
3.1 Orders are placed exclusively online through the Bsport platform (web or app).
3.2 Stages of the process:
Product and affiliated pool selection
Display of contractual information
Shopping cart validation
Choice of payment method
Order confirmation
3.3 Confirmation is made after validation of the payment. Promotional codes must be entered in Bsport.
3.4 After validation, the Customer receives a confirmation email and a summary in his personal account.
3.5 The contract is between the Customer and the local affiliate. Swim Stars España acts as a technical and commercial intermediary.
4. PRICES AND PAYMENTS
4.1 Prices in euros (VAT included), variable according to the pool, class, schedule or public.
4.2 The total price is shown before validation of the order.
4.3 Prices are subject to change at any time. The price in effect on the date of purchase applies.
4.4 In case of manifest errorthe order will be cancelled and the Customer will be informed.
4.5 Accepted means of payment:
Bank card (Visa, Mastercard, AMEX…)
SEPA Direct Debit
Meal vouchers / food vouchers / coupons (depending on the pool)
Customer service credits or vouchers
5. VALIDITY OF PRODUCTS – PACKS AND SUBSCRIPTIONS
5.1 Packs: fixed duration indicated at the time of purchase.
5.2 Subscriptions: valid for periods of 4 weeks, automatically renewable.
5.3 Validity date: from purchase (packs) or first billing (subscriptions).
5.4 Extension of validity possible if:
Physical incapacity > 30 days (with valid medical certificate)
Exceptional closure (technical or force majeure)
5.5 In case of definitive closure without another pool of the same member within a radius of 15 km:
A voucher valid for 1 year is issued
If activity is not resumed, the Customer may request a refund.
⚠ The existence of another swimming pool managed by a different affiliate does not entitle to reimbursement.
5.6 In case of moving with another pool of the same member less than 15 km away, no reimbursement.
6. CANCELLATIONS, ABSENCES AND RESCHEDULING
6.1 On the part of the Client:
Cancellation up to 4h before: credit reactivated
Late cancellation or non-attendance: credit lost
Only recoverable with medical certificate in 72h
6.2 On the part of the local affiliate:
Cancellation (absent coach, technical failure…): credit reactivated
No reimbursement except in cases of article 7
7. REFUND POLICY
7.1 Valid cases:
Final closing of the member’s pool
No other pool from the same affiliate within 15 km
7.2 In this case:
Issued 12 months voucher
If not resumed: possibility of reimbursement
7.3 Excluded from reimbursement:
Unused appropriations
Temporary closures or schedule changes
Absences or late cancellations
Promotions or special offers
Moves with pool of the same affiliate nearby
8. FORCE MAJEURE
8.1 Force majeure is considered:
Epidemics/pandemics
Administrative decisions
Serious technical failures
Urgent closures
8.2 In case of force majeure:
No refund
Only reprogramming or voucher is offered
9. LIABILITY – LIMITATIONS
9.1 Swim Stars España = technical and commercial platform
9.2 Execution of services = local affiliate
9.3 Not responsible for:
Quality of classes
Schedule changes
Incidents in swimming pool
9.4 The contract is exclusively with the local affiliate
10. ACCOUNT SUSPENSION – BEHAVIOR
10.1 Inappropriate behavior (insults, fraud…): possible suspension
10.2 No refund of remaining products or credits
10.3 Reasons for suspension:
Fraudulent use of the system
Duplicate accounts
Abuse of promotions
False declarations
10.4 Right to deny access to anyone in breach of the GTC
11. RIGHT OF WITHDRAWAL
11.1 Right of withdrawal: 14 days from the date of purchase
11.2 If a class is consummated before that deadline, the withdrawal is waived for that party
11.3 Promotional purchases are non-refundable, but a voucher may be offered.
11.4 Requests only valid through the chat in the pool file
12. TERMINATION OF THE CONTRACT (SUBSCRIPTIONS)
12.1 Written cancellation via chat from the corresponding pool
12.2 Subscription without commitment:
Termination at the end of the current period
Give at least 15 days at least 15 days in advance
12.3 Underwriting with commitment:
Leaves only at the end of the commitment period
Early cancellation only with valid justification (moving, health, etc.)
12.4 Every month started is billed in full
13. PROOF OF ORDERS / ARCHIVING
13.1 Purchases managed by Bsport S.A.S.
13.2 Archived information with legal validity
14. CLAIMS AND LIABILITY
14.1 Complaints about the service = local affiliate
14.2 Swim Stars España intervenes only in case of:
Bsport technical failures
Payment problems
Account problems
15. PROTECTION OF PERSONAL DATA
15.1 Processing in accordance with the RGPD and Spanish legislation
15.2 Purpose:
Reservation/payment management
Communications
Legal obligations
15.3 No data is shared with unauthorized third parties
15.4 Rights of access, rectification, etc. by mail to: reclamaciones@swimstars.es (attach ID card)
16. CONFLICT RESOLUTION AND MEDIATION
16.1 The Customer may:
Go to the Consumer Arbitration Board
16.2 Applicable law: Spanish
17. FINAL PROVISIONS
17.1 CGC available at any time at www.swimstars.es
17.2 Future changes applicable after publication
17.3 Mandatory acceptance to make a purchase
18. TEST CLASS (DISCOVERY CLASS)
18.1 Valid only once per student and per member.
18.2 For new customers only
18.3 Multiple use = cancellation without refund
18.4 Reservation implies acceptance of the GTC
